It's about the 14th Amendment. Progressives from both parties have proposed legislation to correct this but it is doubtful it would stand up to appeal even if passed. The 14th is what it is. Of course that was about making sure freed slaves could not be excluded from Congressional seat redistricting. Different context than today's situation.

So, it would take an Amendment to amend an Amendment. Should be doable but getting ANY amendment passed through 3/4 of the states has historically been very difficult. I would also like to see an amendment stripping presidents of pardons. Or at least modifying that power so pardons have to be approved by Congress. Two thirds sounds about right. Presidential pardons are a national embarrassment. Very Dark Ages stuff. Odd that the founding fathers who hated king and star chamber shit would throw presidential pardons into the Constitution. Fixing it is way overdue. I cannot imagine any of the states would not ratify such an amendment. Problem is getting politicians to write it up knowing that pardons couldn't be used by them down the road to get out of jail.
You always conflate different issues into one stance! The 14th Amendment does not require the US Census to count illegal immigrants.
 
It would take more than a trifecta. I think it would require a constitutional amendment.

Regrettably, the 14th amendment is very much in play with respect to who is counted which is why the influx of non-citizens to sanctuary blue states like California and New York , that are otherwise bleeding population, is so important to the democrats.

The apportionment clause of the amendment requires counting the “whole number of persons” in each state, which, to date, has consistently been interpreted to include non‑citizens. It is possible a case could be heard by SCOTUS that would change that interpretation, but I am not holding my breath.

You realize ICE would not be dealing with ANY protestors at all if the "genuine professional armed forces" were doing their job and controlling crowds and dispersing unlawful assembly.

I saw no uniformed policeman anywhere in the situations where crowds were impeding ICE.

The whole thing is on the politicians that told the police to stand down, and incited people to resist.

You might want to consider reading the actual constitution and then reading the various cases challenging different amendments over the years and the outcomes of those cases when heard by the USSC…

The civil liberties guaranteed to US Citizens are NOT all guaranteed to in their full capacity to non citizens…

Or, of course you could also just continue to shout uninformed mindless drivel to a community of people that you don’t know and that don’t know you and hope that anyone gives a shit about your unsubstantiated opinion…

One includes the other, the other however is not all encompassing of the first.

With the reach of Ukraine being significantly extended with their Ukrainian produced Flamingo missile, coupled with the apparent closure of the Baltic to Russian tankers by Germany and Finland, are we seeing the beginning of the end of Putin's ability to continue his war?
Ukraine has seriously rocked the Russian power grid, knocked out oil refinery capability, and greatly reduced Russian fuel supply to the front. Russian air power(?) is not only being taken out by drones, but falling out of the sky on its own due to lack of maintenance and parts. How much longer until Putin plays the only trump card he keeps threatening the world with? Considering the failing shape of the conventional army he is fielding, does he even have a functional nuke?
With the Europeans getting more directly involved in support of Ukraine, actively stopping or seizing tankers, and ships attempting sabotage of undersea cables, I'm wondering if they are also questioning Putin's ability to retaliate; with either conventional means, or worse.
Putin has lost the ability to shield the average Russian from the reality of his war; it has moved onto Russian soil. Their economy is tanking rapidly, and will deteriorate even more quickly with the flow of oil being choked off, and factories shutting down due to lack of power and materiel. Lack of power, food supply at risk, high unemployment. Will Joe Russian do in Moscow what we are seeing Joe Iranian do in Iran finally? Hope so. If Putin and Khomenei are both removed by their own people (this year, hopefully?), that would undoubtedly be a real boon to the world at large. It is looking more realistic every day.

I think that pain may start as the production of the Flamingo missile is ramping up already. With a range of 3000km, Ukraine can reach those cities. If they successfully take out the power grid there, Moscow and St Petersburg will start feeling the pain. Based on the failed Russian attempt to stop Ukraine's retaliation strike, it appears Russian air defense might not be very capable of stopping this Flamingo. Could be a serious game changer for Ukraine.

14th Amendment, Section 2:

"Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed."

"Whole number of persons" ≠ citizens. It means everyone who resides in the states, i.e. everyone counted in the census. Interesting that Indians who didn't pay taxes originally weren't counted. When the 14th Amendment was passed there really was no such thing as illegal immigrants. The doors were still wide open. Many of the western states were inhabited by many, if not mostly by, immigrant farmers and miners without citizenship. Of course they counted.

That sounds like something the republicans should explore, if I understand it correctly the Supreme Court has a conservative majority at the moment and I assume that an interpretetion of the 14th amendment that says only documented citizens can count would probably not be controversial and also hard to overturn for any future democratic majority in the court.

At least it seems like it would be hard to make a case for counting non citizens for congressional seat allocation purposes. It does makes sense to count them for purpose of determining how to dimension the size of for example healthcare, education and daycare but not for voting purposes since I assume that non citizens regardless does not get to vote in the general election.

In Sweden they actually have a vote just by residence status even though they are not citizens, but luckily only in municipal and county elections, not in parlament elections. However they still have to be living here legally to vote in those elections, illegals does not have the rights stated above.
