I am afraid you are mostly right, nothing to see. It's extremely difficult with withdraw a plea for what you bargained for and accepted. However, his only real hope is the Brady violation.

You certainly know much more about dealing with this topic than me. Please help me clarify this.

If:

1. There is written evidence that the DOJ/FBI conspired to set a trap for Flynn.

2. Two FBI agents, wrote their 302's. Then a DOJ attorney along with an FBI employee edited those 302's, completely changing the meaning of the original to initiate a case.

3. Mueller team members had exculpatory evidence and did not provide it to the defendant or the court.

4. Mueller team members had Brady material and did not provide it to the defendant or the court.

5. Mueller team members made a deal with Flynn's attorneys not to prosecute Flynn's son and gave documentation to the court that this did not happen.

6. Defendants attorneys did not share complete information with the defendant regarding conflict of interest, or share with defendant the opportunity to testify before the House Intelligence Committee.

7. Defendants attorneys did not share complete information with the defendant and his new attorneys until the DOJ gave new exculpatory communications between DOJ and defendants initial attorneys.


This is just info off the top of my head.


With the above information in the public domain and probably more information yet to come, do you think Sullivan has any choice but to allow the plea to be withdrawn? Do you think he will allow the plea to stand and force Mueller/DOJ to withdraw the case? Are there other options the judge has?




PS: The judge already has dealt fairly severely with DOJ shenanigans in the Senator Stevens case where he threw the book at the DOJ. (The loss of Stevens is the vote that allowed Obama care to pass by the way)

PS2: The real interesting part of the case is Judge Rudy Contreras who took the Flynn plea initially and then looks to have been forceably recused from the case by Judge Rosemary Collyer. It will be interesting to see how this all plays out.

As Wheels said, you are much more knowledgeable about these matters than I, and probably most others here. I hope you will provide some ongoing insight and help us all stay abreast of and understand matters from the “legal” point of view.

There is so much information coming out since last week it is hard to stay up with it. Flynn is just the start. 2020 will be an epic year.

California Police STAND DOWN After Marine Vet Challenges Their Integrity
In Coleman’s video, a Marine veteran named Cordie Lee Williams can be seen speaking into a megaphone, challenging California police officers to “stand down.”

“In the face of tyranny, in the face of freedom, are you going to sit there in your riot gear against peaceful protesters?” asked Williams. “Or are you going to say, ‘you know what, it’s time to stand up for my country. Because I took an oath of office and it said, ‘I will defend all enemies, foreign and domestic.”

Williams continued, “You might lose your job, but I’d rather lose my job than lose my soul.

“What are you going to tell your little boy or your little girl tonight? That you took your baton and you crushed somebody’s skull, who was a mom? Is that what a tough guy does? That’s not what honor, courage, and commitment means in the Marine Corps.”

Williams then directly challenged the officers’ integrity, “We always have in the military, we have ‘what’s a lawful order.’ And you’ve gotta check your nutsack when you’re given an order, and you’ve gotta say, ‘is this a lawful order or is this a bullshit order?’

“When something’s a bullshit order, and it doesn’t pass the sniff test,” Williams said, “that’s when you say, ‘Sergeant,’ that’s when you say, ‘Colonel,’ that’s when you say, ‘General,’ that’s when you say, ‘Governor, I’m not doing that. I didn’t sign up for that.”
Shortly after Williams challenged the officers to ‘stand down,’ the officers appeared to retreat and leave the location.



 
I think this total lockdown is a symptom of slight mental illness on the part of govt. Their one size fits all doesn't. Most of us have some modicum of cranial acuity and can judge whether to go out or stay in. Limited access and social distancing is working for everyone. Socalled essential entities have no restrictions so I see no need to discriminate against the rest of us. Stinks like a big ego trip for politicians.
