Congressional
Democrats engaged in a high-stakes standoff by refusing to fund
Immigration and Customs Enforcement (ICE) and
Customs and Border Protection (CBP) without significant operational changes. This resistance led to a record-breaking
76-day partial shutdown of the
Department of Homeland Security (DHS) that ended on April 30, 2026, when
President Trump signed a compromise bill that funded most of the department while
leaving immigration enforcement agencies unfunded for the time being.
The standoff ended when House Speaker
Mike Johnson allowed a vote on a bill that funded "non-enforcement" agencies—such as the
TSA,
FEMA, and the
Coast Guard—but excluded ICE and CBP.
- Democratic "Win": Democrats successfully decoupled general DHS operations from immigration enforcement, ensuring other federal workers were paid without conceding on ICE reforms. This was wrong.
- Republican Counter-Strategy: Republicans plan to fund ICE and CBP separately through a process called budget reconciliation, which would allow them to bypass a Democratic filibuster in the Senate.
- ICE Operations: Despite the lack of new funding in this specific bill, ICE and CBP continue to operate using billions in "slush fund" reserves allocated in previous legislation.
- The Freedom Caucus and most Republicans did not want to exclude ICE and CBP funding! So yes, they opposed separating those agencies out and wanted all the agencies funded normally.
This mess was caused by the Democrats. Blaming the Freedom Caucus and other Republicans is ridiculous. Separating out ICE and CBP funding should not have happened.
