Seems like I have. :ROFLMAO: But, in today's world, I wouldn't be surprised if it did happen. Look at the story about a guy who was apprehended the UK for posting pictures of shooting a rifle. :E Shrug:

If it comes from the UK, Canada or Australia it is not that far removed from a joke. I’m sure someone is thinking about this. Guaranteed that this would not be a joke if it happened in Canada. The hero becomes the criminal and the criminal becomes the victim.
 
The Syrian born Australian hero took the correct legal action. If the guy on the ground was no longer armed and he shot the terrorist while he was retreating or crawling away like a bug. In a liberal setting he could definitely be prosecuted.

Be careful when posting online on how you would have shot him. It can be used against you if you are ever in a similar situation. The argument is. you think you are Clint Eastwood or Charles Bronson. Looking for trouble.

I wonder if there could also not be a case made by the defense, that not shooting the terrorist when you have a chance to, could also amount to a certain dereliction of (civic) duty to keep harm from happening to others. I suppose a police officer could have shot the terrorist if he had the slightest suspicion that after running away, the terrorist would continue with his rampage. Would this also apply to a civilian then?
 
I don’t know about Australia. But in the U.S. this is an overview of generally accepted criteria. For criminal prosecution. Civil prosecution has a lower bar.


To demonstrate justification (and avoid liability) for using deadly force. you must typically prove three core elements: Ability, Opportunity, and Intent (sometimes called "Imminent Threat"), showing the attacker had the Ability(means/power) to cause death/harm, the Opportunity (proximity/access) to do so immediately, and the Intent(purpose/design) to cause it, all creating a reasonable belief the danger was immediate and unavoidable.
Here's a breakdown of those key concepts:
  1. Ability: Did the aggressor have the physical capacity or means (like a weapon, size advantage, or skill) to inflict death or great bodily harm?
  2. Opportunity: Was the aggressor in a position to immediately carry out the threat? (e.g., close enough, no significant barriers)
  3. Intent: Did the aggressor demonstrate a clear purpose or design to kill or seriously injure you or others?
Why this matters for liability:
If you can prove these elements existed from your perspective (a reasonable person would have felt the same), you're showing your use of force was necessary, proportional, and based on a reasonable belief of immediate danger, which are key defenses against criminal charges or civil lawsuits.
Other related legal terms:
  • Reasonable Fear: You must genuinely and reasonably believe you're in imminent danger, as a reasonable person would.
  • Proportionality: The force used must be no more than necessary to stop the threat.
  • Innocent Party: You cannot be the aggressor or have started the conflict.
 
Does anyone know how or when the hero who stopped the shooter got shot? In the video I see of him stopping the shooter, and disarming him he looks unharmed.

He then puts the firearm down and almost looks nervous as to what's going on around him. Then later I see he's been shot twice?

I would suspect he was shot by police?

It doesn't ever say in the news reports I have seen. Comments like "riddled with bullets" prior to subduing the shooter, and the data point that one of the terrorists apparently was using a shotgun at least part of the time would suggest the shotgunner had hit him too far away and with too light a shot to incapacitate him. That is just a guess - few of the reports coming out of Australia seem to reflect any understanding of firearms.

The gun seized by the hero is clearly a shotgun with what looks like an extended magazine. To me he does not appear to be wounded in the initial attack, but is clearly so afterwards. Have no idea.

Lots of odd reports out but anything is possible in the confusion and panic of the situation. Glad he stepped in, and hope he gets his citizenship.

I believe you are correct, I have seen a video of the shotgun wielding suspect shooting at people well beyond effective range who were obviously being hit but the hits were non lethal.

Feel about Trump? It's perfectly reasonable to expect the president to act, well, ... presidential. Really, expecting the leader of the free world to act like an adult seems like a pretty low bar. But if your expectations are something less than that, then we're not going to agree on a lot.

Spouting lies like they are truth (Ukraine started it) and doubling down on a murder victim being dead because he was deranged? Why yes, I expect more and better thank you very much.
I use to believe that but not anymore since bill Clinton. I dont think any politician is 100 % honest. And I Realize Trump is a narcissus and an ego maniac, but at the end of the day judge him on what he does for our country not the impromptu things he spouts. Am I 100% agreed on everything He does , of course not, but what was or is the alternative . I would vote for him again for the 4th time if I could and hope I can say that at the end of his term meaning , hope he doesnt do something awful or stupid. I do think he is very transparent which is not presidential.

I remember a story from years ago where a 14(?) year old boy in the UK was home alone when a criminal started breaking into the house.The family had a shotgun and the kid got it. When the criminal succeeded in breaking in, the boy shot him. I don't remember if the guy died,but I do remember that the boy was arrested. The police and government officials made statements that no one wss allowed to take the law into their own hands and it would not be tolerated.

Doesn't sound like much of a joke does it?

Prosecutors said the Egyptian - a 56-year-old - was alleged to have "called for a vehicle attack... with the aim of killing or injuring as many people as possible". The Moroccans allegedly agreed to carry out the attack.

Officials in Germany have been on high alert after previous attacks at Christmas markets, including in Magdeburg last December that killed six people.

They'll just bring in more, and anyone in politics there who wants to do something about it will be labeled a "Putin puppet" or something to that effect, same throughout Europe. The only reason Poland is allowed to enforce their immigration policy is because they have arguably the most capable military in Europe (as far as non-nuclear countries). The EU needs them on the team if people have to actually go die in trenches. The day after the Russia-Ukraine War ends the EU will go back to doing everything in their power to change Poland's immigration policy and create the same conditions Germany is dealing with.

Germany won't do anything about their situation (unless the AfD is in power) even then its going to be a difficult uphill battle. This is their new reality, every year.
