As I recall those allegations of charges were dropped by Special Council Jack Smith and Attorney General Merrick Garland. Both appointed by Biden while Biden was in office.

The President is elected by all the American people. A Federal Judge is elected by 100 Senators. It takes nine Supreme Court Justices to override the President but only one Federal District Judge born in Uruguay. America has some interesting Article 1, 2 and 3 dynamics.
