New USA requirements in addition to the form 4457

NO you are not exempt, you still must file the EEI thru the AES, I believe, still needs a EIN. My questions would be with what CBP do you declare with, at point of Departure or at point of Export, so how do you logistically check your guns thru to the destination, or can you. Just lots of questions that no one seems to have the answers to.

I talked to someone at AES concerning the same issue and was told to use my name and the address of the place I was going.Once I completed the docs and submitted them I was emailed the ITN in about 10 min.Of course you have to sign up for email alerts.

You are exempt from needing an export license but you still have to submit what they call an EEI to obtain the ITN number to give to customs.It is a pain in the neck but you can do it yourself without paying a broker.I couldnt even find a broker that would have anything to do with it anywhere near me so I pretty much had to figure it out out of necessity.(Im flying in 3 weeks).
Where do I get that EEI #.
 
My son and I going together, we have the 4457 and rifle permits is issued in our individual names, but could I use one EEI form to secure the ITN, or would he also have to go thru this dog and pony show...he would need his own EIN if done individually.

FAQ’s regarding AES requirements for the Export of Firearms

What is the law: All persons who intend to travel from the United States to a foreign country with firearms and/or ammunition for either permanent or temporary exportation are subject to federal export licensing regulations. The export regulations for handguns, rifles, associated parts and components, and related ammunition are found in the International Traffic in Arms Regulations (ITAR). Before exporting firearms and/or ammunition with a valid license or qualifying license exemption, the traveler or an agent acting on the traveler’s behalf, must file the Electronic Export Information (EEI) using the Automated Export System (AES).

What has changed: Customs and Border Protection (CBP) is the government agency responsible for all goods coming into and going out of the United States. Historically when personal effects traveled with a person, those goods were not of much interest to the government. (Unless there were goods coming into the country valued more than $2500.00) In 2012 the government became aware that firearms were exiting and entering the United States as accompanied baggage of hunters and there was no record of what left and what returned. In order to track firearms and to comply with the Department of State and the Department of Commerce regulations, Customs and Border Protection (CBP) is now enforcing those 2012 regulations.

Why now: The Department of Commerce has done a major overhaul of the Export Regulations and those new regulations go into effect on May 1, 2015. CBP, the agency charged with enforcing those regulations, has begun telling hunters that their firearms may be seized or confiscated if the rules are not followed.

What do I need to do: In order to comply with the regulations, you must file the Electronic Export Information in AES (Automated Export System) with CBP and receive in return an ITN (Internal Transaction Number). That ITN shows CBP that you have filed an AES and that when you return to the United States, you can prove that you had the gun when you left.

How do I file an AES: There are two ways you can file in AES and obtain an ITN:

# 1 You can file the information yourself with AESDirect.gov. There is no charge to file and the website will explain what you will need to do.

#2 You can have Coppersmith, a licensed Freight Forwarder, file the AES for you for a minimal fee. We will file the information on your behalf, but you must supply a number of items including: A signed Export Power of Attorney, an EIN number, and a completed questionnaire detailing your trip and your firearm’s serial number(s).

What is an EIN: The IRS assigns EIN (Employee Identification Numbers). Previously the exporter could use their Social Security Number instead of the EIN but because of identity theft the EIN is now required. Per the IRS.gov website, to get an EIN you must sign up as a Sole Proprietor and complete the registration. In the comment box you should write “For AES purposes only”. The process takes less than 15 minutes.

What is the cost: You can file your own AES for no charge at www.AESDirect.gov. Or you can have Coppersmith, a licensed freight forwarder, or another qualified third party file the AES for you. You must provide a signed Export Power of Attorney, your EIN, and complete a questionnaire detailing your trip and the firearms you plan to take with you. The cost to file the AES for you is $50.00

Where do I get that EEI #.
From the AES direct shipment info that you complete. you sign up for AES and complete a NEW SHIPMENT, that is you EEI to receive the ITN..oh yes you will enjoy the test of thirty questions.
 
Ok so what this sounds like to me is just let Coppersmith or SSI do all the work for the nominal fee. Am I correct?

EEI is "electronic export information"
First you have to get an EIN# from the IRS website.Then go to aesdirect.census.gov and set up an acct.(you have to pass a quiz)once yiu have an acct you click on "create new shipment".
A few pages back i posted yome tips on what needed to be filled out.and whst workex for me.once you get an acct it only takes about 10 mins to fill in the documents.
 
I used a TWG to book my 4/21/15 trip to Namibia. If I get him the EIN, he will do the rest, no charge (for their customers). That's probably what I'm going to do.

my thoughts exactly, I am semi retired and sitting in the office with not much to do...so this has been my entertainement since yesterday morning. Beats the hell out of cross word puzzles

This is very serious ...... If you are not properly filed, you will be subject to the last paragraph of the ICE Bulletin. Period.
Proceed at your own risk. I just don't get it: hunters spend thousands and thousands of dollars on a hunt and equipment but risk it all by not paying for a filing that some brokers are licensed to do. Forget that we are doing this for free for OUR clients. I am stunned at the risk some people will take.
All you need is a customs broker, anywhere in the US, to file on their AES system. A system that only a valid license holder can have pursuant to CBP and AES (this easily confirmed on their website). Period.
I am still in awe.....

Tuesday I called no fewer than a dozen customs brokers and not one of them would have anything to do with this.The most frequent response I got was"we dont export fireams ANYMORE"..........so I panicked (i am flying in 3 weeks)and went ahead myself out of necessity.
My point is up until the last couple of days it seemed ay if there was no help to be had and it seemedto me that the only other option was to wait and hope someone starts offering the service not to mention I did what I was instucted to do(successfully I might add)by CBP in Syracuse Ny.

2) Robert - 100% agree. 'Ignorance of the law is no excuse'
3) I filed for an EIN yesterday and it was quite easy to do and was issued while in the system (15 minutes)
4) I went through the quiz and established my Admin and User id's with AES yesterday. Took a bit of time, but not difficult. (maybe an hour w/ the quiz)
5) Submitted my shipment information today and have my ITN. (probably 15 minutes)

I leave April 11th for New Zealand and am only traveling with ammunition (using the outfitters rifle) but wanted to be in compliance and legal. Now I am. I will call C&BP at Orlando to confirm who I need to talk to before checking in at the airlines.

Also, if I decide to go to Canada this fall for Whitetail, I've done it and will know how to do it next time and any future international hunting I do (hopefully Africa again in 2016).
 
Sounds like you got thru it ok. I'm going to do it the safe and lazy way. I'll wait to hear from Robert at SSI. As bob said let the experts handle it. I don't like problems.
 
So, just got off the phone with C&BP in Orlando. The officer confirmed my ITN. At first they said I needed to add the rifle serial number. When I told her that I was only traveling with ammunition, she told me I'm good to go, just declare the ammunition as usual with the airline. I've printed out all of my forms to take along as proof. Glad to have this behind me and now I can start packing!

So do you need to go to CBP for any reason? Or is it just check in as usual and see TSA for recheck as usual?
 
I know the feeling.I thought I was all ready to go until a few days ago then this little wrinkle popped up and aboht 3 days of panic ensued.definitely glad to have it behind me........now back to the countdown.
